Crude oil prices eased on Tuesday, extending a recent move downward
as a weak demand outlook amid poor US company results offset tight
supply worries, traders said.
Brent North Sea crude for delivery in December fell 23 cents to $109.21 a barrel in London midday deals.
New York’s main contract, light sweet crude for December, slipped 30 cents to $88.35 a barrel.
“Crude oil prices have been under pressure, tracking losses of the
equity markets as fairly poor corporate earnings results weighed on
market sentiment,” said Sucden Financial analyst Jack Pollard.
Crude markets were weighed by worries over the US economy, with
traders “bracing themselves for a continuation of last week’s slew of
weak earnings from the likes of Google, McDonald’s and IBM,” IG trading
group said in a note to clients.
“There is still a bearish mood over the corporate earnings season with so many misses among blue-chip US stocks,” it added.
Caterpillar, the world’s biggest maker of construction and mining equipment, cut its sales outlook on Monday.
The company, considered a bellwether of the global economy, reduced
its profit and sales forecast for full-year 2012, suggesting a sharp
slowdown in the fourth quarter.
Oil prices had fallen on Monday in the wake of sharp pre-weekend
losses, also as investors balanced poor Japanese export data against
Middle East unrest.
Japan on Monday posted its worst September trade figures in more than 30 years.
The country has been struggling to turn around its fortunes following
the March 2011 earthquake and tsunami disaster, while also suffering
from Europe’s debt crisis, slowing Chinese demand and the strong yen.
All eyes were also on violence in the oil-rich Middle East region, as
hopes of a truce in war-torn Syria during this week’s Muslim Eid
al-Adha holiday remained slim on Tuesday as clashes showed no signs of
easing and the death toll mounted.
Elsewhere, Anglo-Dutch oil group Shell on Tuesday said it may not
meet contractual obligations on certain exports from Nigeria because of
theft and damage to key pipelines in the country’s oil region.

Shell Warns On Nigerian Exports.
Anglo-Dutch
oil group Shell said Tuesday it may not meet contractual obligations on
certain exports from Nigeria because of theft and damage to key
pipelines in the country’s oil region.
“Effective 1400 hours Friday 19th October 2012, SPDC JV declared force majeure on Bonny and Forcados loadings,” the company said in a statement.
SPDC is Shell’s Nigerian joint venture.
Force majeure is a legal term releasing a company from contractual obligations due to circumstances beyond its control.
“Bonny loadings are affected as a result of production deferment caused by the fire incident on a bunkering ship on the Bomu-Bonny Trunkline and production deferment from a third party producer because of flooding,” Shell said.
It said exports from Forcados were affected by damage caused by suspected bunkering – the term for oil theft – on the Trans Forcados pipeline and the Brass Creek trunkline.
Although Shell did not disclose the volume of crude exports affected, industry sources said both Bonny and Forcados account for substantial percentage of Nigeria’s total oil production.
Shell said it was working to repair the pipelines as soon as possible.
Nigeria is Africa’s largest oil producer, exporting between 2.0 and 2.4 million barrels per day in recent months.
Pipeline damage and associated spills are common in the Niger Delta region as a result of oil theft to feed the lucrative black market.
Militants claiming to be fighting for a fairer distribution of oil revenue have also regularly blown up pipelines, though such attacks have decreased since a 2009 amnesty deal.

Sport: Tovey Says That Eagles Can Be Their Own Worst Enemies.
Africa Cup of Nations-winning captain Neil Tovey believes South
Africa can use home advantage to conquer the continent again in the 2013
tournament.
Bafana Bafana (The Boys) are ranked only 19 in Africa and owe a place among the top seeds to being hosts of the three-week championship that kicks off on January 19 at the 90,000-seat Soccer City stadium in Soweto.
But the man who led his country to glory when they hosted the 1996 Africa Cup says getting off to a good start is much more important than where a team stands on the monthly Confederation of African Football (CAF) rankings.
Debutants South Africa walloped Cameroon 3-0 in the tournament opener 16 years ago and Tovey said it was a huge boost for a side that went on to defeat Tunisia 2-0 in a final watched by then-president Nelson Mandela.
“Outplaying Cameroon set the tone for the tournament and gave us breathing space because we were in a difficult group with Angola and Egypt,” he told AFP ahead of the first round draw Wednesday in Indian Ocean city Durban.
“Getting those three points in the opening match meant we had an escape route if things went wrong in another group game. Luckily, we also beat the Angolans and qualified before losing to the Egyptians.
“Playing at home can be a tremendous advantage and everyone rallied behind the team 16 years ago, driving us on to some great victories and the trophy,” recalled Tovey. “South Africa could go all the way again.”
He rates the other three top seeds — defending champions Zambia, 2013 title favourites Ivory Coast and four-time winners Ghana — and second seeds Nigeria among the favourites with Angola and Morocco dark horses.
Tovey raves about Nigeria, a country that has finished among the top three 13 times in 16 Cup of Nations appearances, but failed to even make the finals in Gabon and Equatorial Guinea this year.
“They possess an abundance of talent and my good friend Stephen Keshi is settling down nicely as coach and getting them well organised. He has so many good footballers to choose from.
“However, Nigerian teams sometimes shoot themselves in the foot. They can be their own worst enemies. I do not see that occuring under Keshi, but they must learn from previous mistakes.”
Nigeria have been a hoodoo team for South Africa, whose recently appointed coach Gordon Igesund has confessed he is desperate to dodge the ‘Super Eagles’ in the mini-league first stage.
Keshi is another former Africa Cup-winning skipper, raising the trophy in 1994 after a come-from-behind 2-1 triumph over Zambia, and exudes confidence ahead of the draw at the Durban International Convention Centre.
“I have said it to a lot of people and will say it again that I am not afraid of any team. You do not win a championship by being afraid of your opponents and that is the spirit I am taking to the draw.
“Let them bring on any team and the ‘Super Eagles’ will give their all. We have a team that all opponents — not just those in Africa — should be afraid of,” Keshi told the Nigerian media.
The 2013 line-up includes 10 Africa Cup-winning nations in Zambia, Algeria, Democratic Republic of Congo, Ethiopia, Ghana, Ivory Coast, Morocco, Nigeria, South Africa and Tunisia.
Mali have been runners-up, Burkina Faso semi-finalists, Angola quarter-finalists, Niger and Togo have never gone beyond the first round, and Cape Verde Islands are competing for the first time.
Cape Verde eliminated four-time champions Cameroon 3-2 overall and record seven-time winners Egypt are other notable absentees from the 2013 Cup of Nations, falling in the first round to Central African Republic.
The reason for Cup of Nations tournaments in consecutive years is CAF is switching to uneven-number years for the tournament for the first time since 1965 to avoid every second edition being played the same year as a World Cup.

5 Policemen And 2 others killed B y Robbers in Ogun Stat
FIVE policemen and two civilians were yesterday feared dead after a
15-man armed robbery gang launched three separate attacks on Abeokuta
and Ibafo in Obafemi Owode Local Government area of Ogun State.
Unspecified number of other persons were said to have sustained various degrees of injuries in the attacks said to have started Sunday night.
Vanguard gathered that the first robbery attack took place on Sunday around 8:30 p.m. at a filling station in Ibafo, which reportedly led to the death of two policemen while an undisclosed amount of money was carted away.
The gang members, according to an eye witness, were all in Mobile Police uniforms and said to have operated in a commando style, shooting sporadically into the air.
In the process, a 12- year old boy identified as Mubarak who was hawking sachet water and another yet- to- be identified, were hit by stray bullets.
Similarly, the same gang at 2:30 a.m. yesterday invaded an Apostolic Church located at Ijemo – Agbadu area of Abeokuta, killing three policemen including two Inspectors.
According to a source, the robbers on arrival at the church premises, reportedly lured a five-man police patrol team out of the station at Oke-Itoku and opened fire on the team of a Quick Response Squad, QRS, led by one of the Inspectors, killing three of them including the driver while two others were serious injured.
It was gathered that after their two successful operations, they allegedly went to a hotel on Abiola Way in Abeokuta where they reportedly raided the occupants before escaping.
Confirming the incidents, the Ogun State Police Public Relations Officer, Muyiwa Adejobi, told journalists that it was the same gang that operated at Ibafo that invaded Abeokuta.
He said “the gang had before the Ibafo and Abeokuta incidents snatched a SUV and attacked a hotel located at Abiola Way before heading to the Apostolic Church vicarage at Ijemo Agbadu area of the town where they killed the three policemen and injuring two others.”
According to Adejobi, the robbers were professionals who positioned themselves at different corners before the rescue team ran into their barricade, “Two of our Officers died instantly while another gave up the ghost on the way to the hospital.

News: Court Release Uba Ifanyin Over Fuel Subsidy Fraud
A Federal High Court in Lagos on Monday struck out a bail application
filed by Ifeanyi Uba, the CEO, Capital Oil and Gas, and four others
charged with N43.29 billion fuel subsidy fraud.
Others charged with Uba are Nsika Usoro, Godfrey Okorie, Chibuzor Ogbuokiri, and Joseph Orji, all employees of the Capital Oil and Gas.
The men, being prosecuted by the Nigeria Police Special Fraud Unit (SFU) before a Tinubu Magistrates’ Court in Lagos, were on October 11 ordered to be remanded in the custody of the SFU for 14 days.
Uba and the others were charged with economic sabotage, obtaining money by false pretences, stealing of N43.291 billion, property of the Federal Republic of Nigeria, money laundering and forgery.
Justice Okon Abang, in his ruling described the application as incompetent and defective.
Abang also stated that counsel to the applicant, Mr Joseph Nwobike (SAN), had failed to inform the court that the applicants were detained on a subsisting order of remand, made by Magistrate Martins Owumi.
He said that this fact was not deposed to by the applicants’ counsel in their affidavit of urgency before the court.
“I have gone through the affidavit filed by the applicants’ counsel, and I find no place where it is stated that there was a subsisting order for remand by the magistrate court.I cannot possibly comprehend why the learned SAN has chosen to hide this fact from the court,” he said.
He also stated that although the applicants could bring an application for bail before the court, they could not do so under the Fundamental Human Rights Enforcement Procedure Rules.
“Where bail is refused an applicant at the magistrates’ court, he has the right to bring his application before a higher court, but he has to do so within the confines of the law.
“I cannot make findings on the bail application of the applicants, brought pursuant to the Fundamental Human Rights Enforcement Procedure Rules.
“The applicants cannot use this rule to challenge a subsisting order of court. Whether the magistrate had or exceeded his jurisdiction is entirely a different issue,’’ Abang said.
According to him, the learned SAN should have employed either of three modes in bringing his bail application before this court;
The judge said that the applicants should have appealed against the order for remand made by the magistrate before the high court, pending the arraignment of the applicants.
He said that they could also have sent an application to the high court for a fresh summons for bail, pursuant to Section 118 of the Criminal Procedure Act (CPA).
“I cannot consider counsel’s application for the applicants to be released on bail under the fundamental rights enforcement procedure; this relief cannot be sought under that law.
“This is not a sentimental or emotional issue. It is an issue of law because there already is a subsisting order of court.
“The police possess the constitutional right to arrest any person accused of committing an offence, even if it is based on suspicion.
“In the final analysis, the preliminary objection of the respondent subsists in part and the application of the applicants struck out, with no order as to cost. I so hold” Abang ruled.
Meanwhile, it will be recalled that the Presidential Committee on the Verification and Reconciliation of Fuel Subsidy Payments had indicted Uba and some other oil marketers and companies of financial impropriety. (NAN)

Entertainment: Eko Hotel Where the Headies 2012 by Musician
…As P-Square, Wizkid emerge winners
All the hypes, all the permutations and the razzmatazz came to head on Sunday at Eko Hotel where the Headies 2012 held.
As many observers have pointed out, it was a night of surprises as some artistes who were never given a chance came out shinning, even at the expense of some notable acts who the odds favoured. Yet, some dyed-in-the-wool stars, stood their grounds to prove they are still very much around.
By and large, the great winners are P-Square, the sensational kid, Wizkid and Vector who bagged two awards respectively. The likes of D’Banj, 9ice, Tiwa Savage, Davido, Sound Sultan came calling even though they had a little less than they bargained for.
At least D’Banj would have a consolation of bagging the ‘Song of the Year’ with his ‘Oliver Twist’ album and better still, having to wrestle down P-Square, Davido, Iyanya and Chuddy K and wouldn’t feel any cool either for missing out on the ‘Album of the Year’ which P-Square won.
On the ‘Artiste of the Year’ category, the whole house rooted and rooted for the music sensation of the moment, Wizkid and when the cat was let out of the bag, it was indeed, the twenty-something young lad who came tops, flogging Ice Prince, P-Square, Naeto C. and D’Banj
Other winners include; Best Pop Single for Iyanya – Kukere, Best Rap Single – Angeli -Vector ft 9ice, Best RnB/Pop Album – P Square, Best Street Hop – Chuddy K, Best RnB Pop Album – P-Square,Best Rap Album – Ice Prince – E.L.I, Best Vocal Performance (Male) – Wande Coal – Private Trips, Best Vocal Performance (Female) – Tiwa Savage – Love Me Love Me Love Me, Best Collaboration –, Sound Sultan ft Excel and Flavour – Orobo, Revelation of the Year – Wizkid, Recording of the Year – Brymo – Ara, Producer of the Year – TY Mix – Super C Season (Naeto C), Lyricist on the Roll – Vector – Angeli, Next Rated – Davido, African Artist of the Year – Sarkodie (Ghana) Azonto, Best Music Video (Director) – Jude Okoye – Chop My Money and Headies Hall of Fame – Femi Kuti

News: 17-year-old Marriage Come to An End.
An Ikorodu Customary Court in Lagos State on Monday dissolved the
17-year-old marriage between Mr Adewole Agbolade and Mrs Kafayat
Agbolade after the husband accused the wife of fetish practises.
The Court President, Mrs Riskat Ekerin, said that all efforts to reconcile the couple had proved futile as the petitioner insisted on divorce.
Ekerin, however, ordered the petitioner, Adewole, to give the respondent, Kafayat, one of the houses which he built as compensation, as he had earlier promised.
She also ordered that the children from the union should remain with the petitioner until the final resolution of the issue of custody by the family court.
“I once saw a horn tied with red cloth in my wife’s handbag,” Adewole, who resides at Igbe area of Ikorodu,’’ had told the court on Aug.15.
He had also accused Kafayat, aged 35, of making incisions on the head of his five children without his consent or knowledge.
“I travelled for two days and before I got back home my wife had made incisions on the head of my five children.
“My children told me after I returned from my trip that she brought an Alfa (Priest) home to do it.
“She also engages me in fights a lot and curses me every day; please separate us as I don’t want her to kill me,” he said.
The charms were tendered as exhibits before the court.
Kafayat, a trader, in her testimony did not deny the claims and allegations by her husband.
“Truly, he saw charms in my bag, but they were not meant to destroy his life; I used those charms to sell my own market and I never used them to do evil.
“I want this court to plead on my behalf; I don’t have anywhere to go. I still want to be his wife,” she had said. (NAN)

News: Footballer like Pienaar, Eto and others fight against Malaria.
DURBAN, South Africa – Ahead of the official draw for the 2013 Orange
Africa Cup of Nations (AFCON), African football stars and heads of
state have joined United Against Malaria (UAM) in the distribution of
life-saving malaria prevention and treatment messages throughout the
tournament.
Football icons including Didier Drogba, Samuel Eto’o and Steven Pienaar, along with African Leaders Malaria Alliance (ALMA) heads of state including President Ellen Johnson Sirleaf of Liberia, President Jakaya Kikwete of Tanzania, President Blaise Compaoré of Burkina Faso, President Alassane Ouattara of Cote d’Ivoire and President Yoweri Museveni of Uganda, will lend their voices to the cause, appearing in television spots, billboards and educational materials that will be distributed across Africa.
“Across the continent, football dominates the hearts and minds of children and parents alike. But, so does malaria – the cause of 174 million illnesses and nearly 600,000 deaths in Africa alone every year,” said Samuel Eto’o, Cameroonian national team player and UAM champion. “We have united to utilize the power of football to fight malaria and we hope our fans will join us.”
Although preventable and treatable, malaria kills a child in Africa every 60 seconds and costs the continent an estimated minimum of US $12 billion in lost productivity and healthcare costs each year.
“I have been a victim of malaria and have witnessed first-hand the devastating effects it can have on individuals and families,” said Didier Drogba, Côte d’Ivoire national team captain and UAM champion. “We need malaria out of the game. Using the popularity of football to increase awareness of prevention and treatment methods will go a long way in the fight to show malaria the red card.”
By leveraging the popularity and excitement surrounding Africa’s signature tournament, the Confederation of African Football (CAF) and UAM are partnering to disseminate life-saving malaria messages through television and radio spots, in-stadium branding and local outreach to policy-makers and millions of fans across the continent.
“Malaria affects nearly everyone on the continent of Africa, including footballers and government leaders. With all eyes on the tournament and its participants, CAF and UAM are committed to utilizing this platform to communicate important messaging to end deaths from this devastating disease,” said Mr. Hicham El Amrani, secretary general of CAF.
Activities kicked off during tournament qualifying matches as President of Liberia Ellen Johnson Sirleaf surprised football fans at the friendly game between Liberia and Ghana to cheer on her national team and congratulate them for their efforts to fight malaria. “When we all fight malaria together, we build a stronger nations and save lives,” said President Ellen Johnson Sirleaf of Liberia. “As a football fan myself, I understand the game’s power and popularity. We have the tools to win against malaria and I urge others to join us in the fight.”
In Nigeria, Malawi, Benin, Ghana, Uganda, Tanzania and other countries, malaria messages will be shared using football players, favorite teams and sports programs. Research has shown that audiences retain and act on these messages more often when delivered by their football heroes. In those countries, billboards, sports journals, tournament programs will complement the PSAs on air to ensure the UAM campaign messages reach every household. In Cote d’Ivoire, images of Drogba and his teammates Kolo Toure, Gervinho and Salomon Kalou attract readers to malaria educational materials, and create excitement about ridding this West African country of the burden of malaria. The UAM campaign has broken language barriers by having PSAs recorded by football stars in over 18 African languages since the campaign was launched in 2009.
“I am honored to be a champion for this cause,” said Steven Pienaar, UAM champion and former South African captain. “It is unacceptable that malaria kills one child in Africa every minute. We can take such simple steps to prevent and treat this disease. United we can beat malaria.”

News: Amendment of people's Constitution
THE House of Representatives is giving Nigerians an opportunity to
participate in amending the 1999 Constitution. It is a novel idea billed
to hold from 10am on Monday November 5 in all 360 federal
constituencies of the country.
It may be a response to calls for a sovereign national conference or an attempt to correct the lie that prefaces the 1999 Constitution which states that Nigerians gave themselves the document.
The House calls the move a fulfillment of its pledge, in 2011, to make governance more inclusive. It is an opportunity for Nigerians – of various levels of understanding – to participate in the making of the Constitution. The only amendment, in 2010, was on electoral reforms. Nigerians want more.
From the 136 memoranda the House Constitution Review Committee has received, the dominant issues appear to be –
· Indigeneship, Residency and Citizenship
· Immunity clause, accountability, judicial reform
· National Security and Police Reform
· Fiscal Federalism, Local Governance and Restructuring/Devolution of Powers
· Financial Autonomy for Local Government Councils
· Removal of the Land Use Act and the National Youth Service Corps from the Constitution
· Part time legislature
· Abolition of Joint States/Local Government Account System
· Voting Rights for Nigerians living in the Diaspora
.·. Zoning/rotation of offices of President/Governors
Nigerians should not restrict themselves to these issues. More pressing matters like how the Constitution should, beyond words, guarantee the security and welfare of the people are important.
What have governments since 1999 done with Section 14 2(b) of the 1999 Constitution which states the “security and welfare of the people should be the primary purpose of government”? Why is it possible to ignore such a powerful provision while carrying on with the rites of governance?
Is it possible to have provisions in the new Constitution to make governments accountable? What can citizens do when governments ignore provisions of the Constitution and immunity which protect them?
The sessions would be replete with people’s anger on several fronts. For some, it could be the first time they would have a chance of meeting their representatives. Others could think the Constitution would be the solution to all challenges the country faces.
All views should be heard and accommodated in the reports. The people, on their part, should utilise the platform the House of Representatives is giving them to be more than statistics in the affairs of Nigeria.
Improved inclusiveness and participation of communities across Nigeria in amending the Constitution could sensitise legislators to the diversity of views even on issues that are considered generally acceptable to the people.
Nigerians should avail themselves this unique opportunity to have a strong say on their future and their country

News: Cause of National Insecurity
WIFE of the Chief of Defence Staff and National President, Defence
and Police Officers Wives Association, DEPOWA, Mrs. Dupe Ibrahim,
weekend, attributed the cause of insecurity in the country, to failure
on the part of women to bring up their children properly.
The former National President of the Naval Officers Wives Association, NOWA, who spoke during an official hand-over ceremony to the association’s new National President, Mrs. Vivian Ezeoba, called on women in Nigeria to inculcate good morals into their children to ensure peace and stability in the country.
Stating emphatically that the role of women in nation building could never be overem- phasized, Mrs. Ibrahim who is the first NOWA national president to assume the position of DEPOWA president, admonished, “ This is a time Nigeria needs our prayers, particularly in the area of insecurity. As women, your children are your property .
Therefore, talk to them always, know when they go out, who they go out with and when they come back home. “If we had taken care of our children and trained them well, there would not have been insecurity in the country.
This is because if you are not there to train them , others will take care of them for you. Women are to be blamed for the state of insecurity.”

Ondo Guber: Mimiko Declares Winner.
INEC declares Mimiko as winner of Ondo guber poll with 260,199 votes, ACN - 143,512 votes and PDP 155,961 votes
Ondo Guber: ACN Alleges Violence, Irregularities.
The Action Congress of Nigeria (ACN) has said Saturday’s governorship
election in Ondo State was marred by irregularities and widespread
violence that either scared away many voters or significantly affected
voting in many polling units.
In a statement issued on Saturday by its National Publicity Secretary, Alhaji Lai Mohammed, from the the party’s Election Situation Room, ACN said the violence was caused by inadequate security, as most of the security agents deployed for the election were only able to effectively cover the urban areas, inadvertently leaving the rural areas thinly secured and paving the way for thugs to have a free rein.
The statement also stated that the delay and inadequacy of election materials and the absence of election officials in many polling units, especially in the rural areas, did not create a conducive environment for a free, fair and credible election.
The party said long before voting started, it had been warning about the violence in many areas, including Idanre, Okitipupa and Owo, where some top government functionaries in the State were allegedly arrested after they were found with six AK-47 guns in the early hours of the day.
ACN said the general impression about the election being largely devoid of violence stemmed from the fact that media coverage was concentrated on the urban areas, whereas most of the violence was perpetrated in the rural areas.
